Enforcing Child Support Orders
When a court orders one parent to pay child support, those payments are legally required. Failure to comply with a support order can lead to serious consequences, including a finding of contempt of court—a ruling that can result in fines, community service, or even jail time.
Under California Code of Civil Procedure §1218(c), penalties for willful nonpayment may include:
- First offense: Up to 120 hours of community service or imprisonment
- Second offense: Both community service and up to 120 hours of imprisonment
- Third or subsequent offenses: Up to 240 hours of community service, imprisonment, and administrative fees
In addition to these penalties, the court can suspend the nonpaying parent’s driver’s license or professional license, levy bank accounts, and intercept tax refunds to recover overdue support.
